Fed Judge Rules Against Ban On Bikini Baristas

A federal court has ruled as unconstitutional dress code ordinance in Everett, Washington, that said bikini baristas must cover their bodies at work.

  • The court made the decision last week in a partial summary judgment – after a lengthy legal battle between bikini baristas and the city over workers’  rights to wear what they want.
  • Everett is about 30 miles north of Seattle.
  • U.S. District Court in Seattle found the ordinance violated the Equal Protection clauses of the U.S. and state constitutions.
  • According to the ruling signed by U.S. District Judge Ricardo S. Martinez, the ordinance was at least in part shaped by a gender-based discriminatory purpose.
