- The Idaho law was adopted in 2020 and is set to go into into effect Aug. 25 following the Supreme Court’s decision overturning Roe v. Wade
- The DOJ claims the law violates the federal Emergency Medical Treatment and Labor Act, which requires the termination of a pregnancy if a woman’s life is in danger
- But the Idaho law allows for exceptions for rape or incest that has been reported to police, and also permits ‘good faith’ procedures to save a woman’s life
